Our Guide to Lasting Powers of Attorney

We are delighted to launch our guide to acting under a Lasting Power of Attorney or ‘LPA’.

For those of you who are not familiar with this arrangement, an LPA enables you to take control of who makes decisions for you in the future when you may feel less able to control your finances or lack capacity to look after your own affairs. We believe that setting up an LPA is a key element of your financial health and leaving you in charge of your affairs. We advise everyone to ensure that they have this highly useful arrangement in place well before it might be needed, particularly because registration delays are common at the moment. Setting up an LPA does not require the input of a solicitor and the process can be completed online on payment of a small onetime fee. We can safely retain a copy for you or, for LPA arrangements set up most recently, you can simply provide us with an access code.

The Guide is aimed at those who may need to act as an attorney under an LPA, anyone who has established a Lasting Power of Attorney  and those thinking about this as one of their New Year’s Resolutions. We address topics such as what the differences are between a Health and Welfare LPA and a Finance and Property LPA and what powers an attorney has under each arrangement. The Guide is intended to be highly practical to help you navigate the jargon and government procedures. It includes guidelines around paying bills, gifting and dealing with third parties. We also include information from those who have created an Enduring Power of Attorney or EPA. And there are useful links to third party resources and a helpful glossary of terms.
